DMCA & Copyright Policy

Berks Connect respects the intellectual property rights of others and expects our users to do the same. This policy outlines how we respond to claims of copyright infringement in accordance with the Digital Millennium Copyright Act of 1998 ("DMCA").

Our Commitment to Copyright Protection

We take copyright infringement seriously. It is our policy to:

  • Respond promptly to valid DMCA takedown notices
  • Remove or disable access to material that infringes copyright
  • Terminate repeat infringers in appropriate circumstances
  • Provide a fair process for counter-notifications

Reporting Copyright Infringement

If you believe that content on Berks Connect infringes your copyright, you may submit a DMCA takedown notice to our designated agent. To be effective, your notice must include the following information:

Required Elements of a DMCA Notice

  1. Physical or electronic signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work: Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of the infringing material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Please provide the URL(s) of the page(s) containing the allegedly infringing material.
  4. Your contact information: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
  5. Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy and authority statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Important Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees. Please be certain that the material you are reporting is actually infringing before submitting a notice.

What Happens After We Receive Your Notice

Upon receiving a valid DMCA takedown notice, we will:

  1. Review the notice: We will review the notice to ensure it contains all required elements.
  2. Remove or disable access: If the notice is complete and valid, we will expeditiously remove or disable access to the allegedly infringing material.
  3. Notify the user: We will make a good faith effort to notify the user who posted the content that it has been removed.
  4. Provide counter-notification information: We will inform the user of their right to submit a counter-notification.

Counter-Notification

If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification. To be effective, your counter-notification must include:

  1. Physical or electronic signature: Your physical or electronic signature.
  2. Identification of removed material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  3. Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  4. Your contact information: Your name, address, and telephone number.
  5. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Eastern District of Pennsylvania if you are outside the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Restoration of Removed Material

Upon receiving a valid counter-notification, we will:

  1. Promptly provide the complainant with a copy of your counter-notification
  2. Inform the complainant that we will restore the removed material in 10 business days
  3. Restore the removed material 10-14 business days after receiving the counter-notification, unless our designated agent first receives notice from the complainant that they have filed an action seeking a court order to restrain you from engaging in infringing activity

Repeat Infringers

In accordance with the DMCA and other applicable law, Berks Connect has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

While the DMCA specifically addresses copyright, we take all intellectual property concerns seriously and will review non-copyright claims on a case-by-case basis.

Good Faith and Fair Use

Before submitting a DMCA notice, please consider whether the use of your copyrighted material might constitute "fair use." Fair use is a legal doctrine that permits limited use of copyrighted material without requiring permission from the rights holders. Factors that courts consider in determining fair use include:

  • The purpose and character of the use (commercial vs. educational, transformative vs. copying)
  • The nature of the copyrighted work
  • The amount and substantiality of the portion used
  • The effect of the use on the potential market for the copyrighted work

If you are unsure whether a particular use constitutes fair use, you may wish to consult with an attorney before submitting a DMCA notice.

Content Guidelines

In addition to copyright compliance, all content on Berks Connect must comply with our Content Guidelines, which prohibit posting content that infringes the intellectual property rights of others. Users should only post content they have created themselves or have permission to use.
