Mortgage Foreclosure Diversion Program From the Berks County Court
The Berks County Court of Common Pleas runs the Mortgage Foreclosure Diversion Program, established in 2012 to give the parties in a residential mortgage foreclosure action a procedure for resolving the foreclosure complaint while letting defendant homeowners remain in their homes.
It is meant for the parties in a residential mortgage foreclosure case, including the homeowner who has been sued as the defendant.
The program operates under an Administrative Order effective 9/25/2023 and a Supplemental Order effective 11/5/2025. Court Administration publishes a Mortgage Foreclosure Diversion Program Application and a set of required forms effective 11/5/2025:
- Urgent Notice, in English or Spanish
- Certification of Status
- Defendant's Packet Cover Letter
- Mortgage Foreclosure Diversionary Program Checklist
- IRS Form 4506-T (Request for Transcript of Tax Return)
- Fannie Mae/Freddie Mac Form 710 (Mortgage Assistance Application), in English or Spanish
- Expense Statement
The Urgent Notice and Form 710 are each posted in an English version and a Spanish version. Those are the same document in two languages, so use the one you read rather than both.
The forms are posted as documents to download at berkspa.gov/departments/court-administration/mortgage-foreclosure-diversion-program. The page does not say where to send the application, whether there is a deadline, how a conference is scheduled, how long the process takes, or whether the program costs anything, so ask the court before you rely on it.
Court Administration for the Berks County Court of Common Pleas is at the Berks County Services Center, 4th Floor, 633 Court Street, Reading, PA 19601.
